HB 2671 in 60 seconds — what agents need to know

  • Not mandatory, but standardized: the law kicks in when any party — lender, agent, buyer — requests an inspection as a condition of the deal. It covers sales, refinances, and title transfers.
  • Licensed inspectors only: DPOR Onsite Sewage System Operator, Installer, or Soil Evaluator. Home inspectors can't legally cover the septic side — we partner with several local ones.
  • A complete inspection includes pumping. The client can decline pumping in writing (Form 600M documents this), but the report then reflects an incomplete inspection.
  • 10 business days for the written report — measured from the start of the inspection (clarified July 1, 2026). Our guarantee: 48 hours.
  • No pass/fail. The report states whether the system operates as intended; findings are negotiated. As of July 2026, bedroom-count comparison was removed from report requirements.
  • Listing on an alternative system (AOSS)? Buyers' lenders increasingly want proof of the legally required annual O&M contract. Sellers with our maintenance contracts get a service-history letter for the listing packet.
